Wills, Tax, Trust & Probate

What can we do to help you to put your affairs in order, to give you and your family peace of mind? That is our first and paramount consideration.

Wheelers LLP has had a specialist private client department since we were established in 1979. During this period we have advised and assisted hundreds of clients and their families to sort out those, often complex, questions about their property, assets and financial affairs.

How we can help

Wills - The future well being of your family may depend on your having prepared an effective and legally binding Will. If you do not make a Will your property and other assets may not pass in accordance with your wishes. Using our specialist knowledge of property trusts and tax law, we can also help you cater for a number of different possibilities.

You may well have prepared a Will some years ago. As a result of changes in your family or financial circumstances, however, it may no longer reflect your  wishes. Alternatively, changes in the inheritance tax provisions may have occurred which could mean you end up paying more in tax than need be. In either case we can review and advise on any changes you are considering.

Lasting Power of Attorney - Have you considered who would manage your affairs if you became mentally incapable of handling things yourself? Many clients have had the foresight and wisdom to ask us, as their solicitors, to prepare an Enduring Power of Attorney in order to minimise the problems should this situation arise.

Court of Protection - If a relative has not executed an Enduring Power of Attorney before becoming mentally incapacitated, we can assist you with an application to the Court of Protection for the appointment of a receiver to manage their financial affairs.

Tax and estate planning - Tax law is complex and forever changing. We can advise you on the best way to plan ahead and to arrange you tax affairs during your lifetime to minimise the amount eventually payable.

Trusts - We can advise you about setting up all types of trusts and the benefits and implications of doing so. If you are a trustee we can advise you of your duties and obligations and assist you with the administration of the trust.

Help for personal representatives - Personal representatives are the people named in a Will to act as executor, or the next of kin of someone who has left no Will. Being a personal representative has heavy responsibilities and can be legally difficult. This is quite apart from the fact that after the loss of someone close to you, dealing with these matters may prove personally distressing. With this in mind we can relieve you of the burden of ‘getting Probate’ and help you ensure that the wishes of the deceased are followed.

Long-term residential care - It is a fact of life that many people may need to go into a nursing home or some other form of long term residential care when they get older. It is also true that your capital and home can be used to pay for this care. Simply transferring the ownership to your children is no guarantee that your house is protected from being used to pay for fees. We provide advice and practical help on dealing with this sort of situation.

Testimonial

I would like to thank you very much for the kind and sensitive way you treated my father. At 93 he finds it difficult to follow things now but was able to understand everything well, and is very pleased to have his affairs sorted to his satisfaction. Many thanks for understanding.
